Structure entails arrangements and interrelations of parts that organize the whole (i.e., personality). It involves stability of traits over time. Extraversion varies along a continuum towards introversion. Multiple behavioral and biological variables in several systems vary and are regulated homeostatically within the normal range. If there is a fixed point for an individual, what inhibits variation in the biological parameter?

This article offers a qualified defence of the view that there is a moral difference between telling lies to one's patients, and deceiving them without lying. However, I take issue with certain arguments offered by Jennifer Jackson in support of the same conclusion. In particular, I challenge her claim that to deny that there is such a moral difference makes sense only within a utilitarian framework, and I cast doubt on the aptness of some of her examples of non-lying deception. But I argue that lies have a greater tendency to damage trust than does non-lying deception, and suggest that since many doctors do believe there is a moral boundary between the two types of deception, encouraging them to violate that boundary may have adverse general effects on their moral sensibilities. In this paper, for the benefit of reflection processes in clinical and in local, regional, and national priority-setting, we aim to develop an ethical theoretical framework that includes both ethical principles and medium-range narratives. We present our suggestion in the particular case of having to choose between treatment interventions for attention deficit hyperactivity disorder (ADHD) and treatment interventions for other conditions or diseases, under circumstances of scarcity. In order to arrive at our model, we compare two distinct ethical approaches: a (...) generalist (principles) approach and a particularist (narratives) approach. Our focus is on Sweden, because in Sweden prioritization in healthcare is uniquely governmentally regulated by the “ethics platform.” We will present a (fictional) scenario to analyse the strengths and weaknesses of the generalist principled perspective of the ethics platform and the particularist perspective of narrative ethics. We will suggest an alternative (moderately particularist) approach to prioritization, which we dub a “principles plus medium-range narratives” approach. Notwithstanding the undeniably central role of principles in distributive justice, we claim that medium-range narratives concerning individuals or groups who stand to benefit or lose from ADHD prioritization practices should also be read or listened to and taken into account at all levels of priority-setting. These narratives are expected to ethically optimize clinical priority-setting, as well as that undertaken at local, regional, and national levels. (shrink)

This article examines various models of legal interpretation and their implications for comparative law, drawing inspiration from Rodolfo Sacco’s early career theories. It contrasts the Tarskian Correspondence Model, which seeks objective reality in legal texts, with the Symphonic Model, which interprets legal language as a harmonious interplay of elements. The Tarskian model reflects classical legal thought’s search for fixed meanings, while the Symphonic model aligns with contemporary legal practice’s nuanced understanding. Further, the article explores Heraclitean Realism, acknowledging the fluidity of (...) language and meaning, and the Provocative Tapestry Model, which introduces paradox and tension in legal interpretation. These models are likened to narrative genres, offering varied approaches to understanding legal discourse: the Tarskian model as a detective novel, the Symphonic model as a comedy, the Living Tapestry model as a melodrama, and the Provocative Tapestry model as a tragedy. The article argues that these models of legal interpretation do not inherently carry a political essence; the political stance emerges from the choices of interpreters. It emphasizes the need for human agency in the application of legal norms and the responsibility of legal professionals to actively engage in the interpretation process. Comparative law is discussed as a discipline that benefits from understanding these diverse interpretative models, as it seeks to analyze legal systems across jurisdictions. The article concludes that while narrative styles in legal interpretation have political histories, they are not bound to specific ideologies, highlighting the versatility and subjectivity in the field of legal interpretation. The binding problem is fundamental to visual perception. It is the problem of associating an object's visual properties with itself and not with some other object. The problem is made particular difficult because different properties of an object, such as its color, shape, size, and motion, are often processed independently, sometimes in different cortical areas. The results of these separate analyses have to be combined before the object can be seen as a single coherent entity as opposed to a collection (...) of unconnected features. Visual bindings are typically initiated and updated in a serial fashion, one object at a time. Here, we show that one type of binding, location-identity bindings, can be updated in parallel. We do this by using two complementary techniques, the simultaneous-sequential paradigm and systems factorial technology. These techniques make different assumptions and rely on different behavioral measures, yet both came to the same conclusion. (shrink)

This article addresses the long-standing problem of how to understand Mill’s famous harm principle in light of his failure to specify what counts as “harm” in On Liberty. I argue that standard accounts restricting “harm” to only certain negative consequences fail to do justice to the text, and that this fact forces us to rethink Mill’s defense of individual liberty. I then offer a new account of that defense in which “harm” is understood in an expansive sense, despite apparent problems (...) for such a view. (shrink)

“Self-transcendence” is proposed as a way in which individuals might find relief and support in the context of COVID-19, as well as other times of uncertainty. However, the authors propose that the multiple definitions of self-transcendence within existing literature lean towards the complex, sometimes obscure, and imprecisely spiritual. A concern is that this creates a circumstance, where the possibility of supporting self-transcendence in a wider population will become excluding in this complexity. In this paper, we have undertaken a critical summary (...) review focused primarily on historical foundations of the concept of self-transcendence, and key theoretical approaches in which self-transcendence and self-transcendent experiences are discussed with the motive of finding a clarity to understanding self-transcendence and the pathways towards it. We argue that this much-needed clarity in our understanding of self-transcendence may serve as an inclusive and democratized resource in which to support well-being and resilience in the context of COVID and beyond. One of the challenges confronted by language learners is to master the interpretation of sentences with multiple logical operators, where different interpretations depend on different scope assignments. Five-year-old children have been found to access some readings of potentially ambiguous sentences much less than adults do :73–102, 2006; Musolino, Universal Grammar and the acquisition of semantic knowledge, 1998; Musolino and Lidz, Lang Acquis 11:277–291, 2003, among many others). Recently, Gualmini et al. have shown that, by careful contextual manipulation, it is possible (...) to evoke some of the putatively unavailable interpretations from young children. Their proposal is quite general, but the focus of their work was on sentences involving nominal quantifiers and negation. The present paper extends this investigation to sentences with modal expressions. The results of our two experimental studies reveal that, in potentially ambiguous sentences with modal expressions, the kinds of contextual manipulations introduced by Gualmini and colleagues do not suffice to explain children’s initial scope interpretations. In response to the recalcitrant data, we propose a new three-stage model of the acquisition of scope relations. Most importantly, at the initial stage, child grammars make available only one interpretation of negative sentences with modal expressions. We call this the Unique Scope Assignment stage. (shrink)

Neurodiversity has remained a controversial concept over the last decade. In its broadest sense the concept of neurodiversity regards atypical neurological development as a normal human difference. The neurodiversity claim contains at least two different aspects. The first aspect is that autism, among other neurological conditions, is first and foremost a natural variation. The other aspect is about conferring rights and in particular value to the neurodiversity condition, demanding recognition and acceptance. Autism can be seen as a natural variation on (...) par with for example homosexuality. The broad version of the neurodiversity claim, covering low-functioning as well as high-functioning autism, is problematic. Only a narrow conception of neurodiversity, referring exclusively to high-functioning autists, is reasonable. We will discuss the effects of DSM categorization and the medical model for high functioning autists. After a discussion of autism as a culture we will analyze various possible strategies for the neurodiversity movement to claim extra resources for autists as members of an underprivileged culture without being labelled disabled or as having a disorder. We will discuss their vulnerable status as a group and what obligation that confers on the majority of neurotypicals. (shrink)

We offer a proof of the duality theorem for finitely presented MV-algebras and rational polyhedra, a folklore and yet fundamental result. Our approach develops first a general dual adjunction between MV-algebras and subspaces of Tychonoff cubes, endowed with the transformations that are definable in the language of MV-algebras. We then show that this dual adjunction restricts to a duality between semisimple MV-algebras and closed subspaces of Tychonoff cubes. The duality theorem for finitely presented objects is obtained by a further specialisation. (...) Our treatment is aimed at showing exactly which parts of the basic theory of MV-algebras are needed in order to establish these results, with an eye towards future generalisations. (shrink)

The paper lists several editions of Euclid’s Elements in the Early Modern Age, giving for each of them the axioms and postulates employed to ground elementary mathematics.

We prove that the unification type of Łukasiewicz logic and of its equivalent algebraic semantics, the variety of MV-algebras, is nullary. The proof rests upon Ghilardiʼs algebraic characterisation of unification types in terms of projective objects, recent progress by Cabrer and Mundici in the investigation of projective MV-algebras, the categorical duality between finitely presented MV-algebras and rational polyhedra, and, finally, a homotopy-theoretic argument that exploits lifts of continuous maps to the universal covering space of the circle. We discuss the background (...) to such diverse tools. In particular, we offer a detailed proof of the duality theorem for finitely presented MV-algebras and rational polyhedra—a fundamental result that, albeit known to specialists, seems to appear in print here for the first time. We are very grateful to Chong-Ming Lim for his thoughtful reply published in this journal on one of our articles, which motivated us to think more carefully about accommodating autistic individuals and treating autism. However we believe there are some confusions in Lim's argument. Lim uses the accommodation thesis, according to which we should accommodate autistic individuals rather than treat autism, as the starting point for his reasoning. He claims that if the accommodation thesis is right, then we should not (...) treat autistic individuals for their autism, not even low-functioning ones, because this would be disrespectful to all autistic individuals. We should instead limit ourselves to accommodate all autistic individuals. However, the opposition between accommodation and treatment is not valid in the case of autism, because of ambiguity in the concepts of accommodation and treatment. Moreover there is confusion in Lim's reasoning caused by omitting important facts about the practice of treating autism. (shrink)

The main aim of the paper is to reinforce the notion that emergence is a basic characteristic of the molecular sciences in general and chemistry in particular. Although this point is well accepted, even in the primary reference on emergence, the keyword emergence is rarely utilized by chemists and molecular biologists and chemistry textbooks for undergraduates. The possible reasons for this situation are discussed. The paper first re-introduces the concept of emergence based on very simple geometrical forms; and considers some (...) simple chemical examples among low and high molecular weight compounds. On the basis of these chemical examples, a few interesting philosophical issues inherent to the field of emergence are discussed – again making the point that such examples, given their clarity and simplicity, permit one to better understand the complex philosophical issues. Thus, the question of predictability is discussed, namely whether and to what extent can emergent properties be predicted on the basis of the component’s properties; or the question of the explicability (a top down process). The relation between reductionism and emergentism is also discussed as well as the notion of downward causality and double causality (macrodeterminism); namely the question whether and to what extent the emergent properties of the higher hierarchic level affect the properties of the lower level components. Finally, the question is analyzed, whether life can be considered as an emergent property. More generally, the final point is made, that the re-introduction of the notion of emergence in chemistry, and in particular in the teaching, may bring about a deeper understanding of the meaning of chemical complexity and may bring chemistry closer to the humanistic areas of philosophy and epistemology. Introduction Two ethical challenges of nursing home nurses during the COVID-19 pandemic in Sweden are discussed in this paper. Background Historically, the nurse’s primary concern is for the person who is ill, which is the core of nurses’ moral responsibility and identity. In Sweden, person-centered care is generally deemed important in nursing older nursing home residents. Objective To chart moral responsibilities of nursing home nurses in two cases involving older residents during the COVID-19 pandemic in Sweden. Methods We used Margaret (...) Urban Walker’s framework for moral responsibilities and the International Council of Nurses (ICN) code of ethics for nurses (2021) for our normative analysis. Ethical considerations Written and verbal consent was obtained before the interviews, and information was given that participation was entirely voluntary and possible to cancel at any time before the work was published. The Swedish Ethical Review Agency gave an advisory opinion stating that there were no ethical objections to this research project (Dnr. 2020-05649). Findings Case #1: a palliative older nursing home resident who was coercively tested for COVID-19, and case #2: a COVID-19–infected resident with dementia who was isolated using sedation. The decision that was finally made in the respective case was analyzed in the light of either consequentialist/utilitarian or non-consequentialist/deontological reasons. Discussion Empowerment of nurses as moral agents is required for the application of practical wisdom in the balancing of different care relationships (responsibilities), moral identities (professional virtues), and competing moral values. This requires resources and opens possibilities for profound ethical reflection in nursing education and at work. Conclusion During the COVID-19 pandemic, the moral and professional responsibility of nursing home nurses to deliver person-centered care was sometimes problematically abandoned in favor of a more utilitarian manner of ethical decision-making. This article aims at sketching a philosophical theory of sound based on the perspective of sound designers: unique agents blurring the boundaries between engineering, music, acoustics and sound-based art. After having introduced the general framing in Section 1, focusing on a short history of the theory and practice of sound design, in Section 2 we propose a reading of sound as monad. We derive such intuition from the technology of digital sampling of audio signals, based on the decomposition of complex (...) sound waves in a number of elementary sinusoidal waves. Thus, in Section 3, we attempt at grounding the resulting “sound-atom” on Leibniz’s notion of monad, intended both as a “simple substance without parts” and as a “nucleus of forces in statu possibilitatis.” The insight is resumed and further discussed in Section 4, where we draw our conclusions by demonstrating the fitness of such framing with regards to the standpoint of sound design, while accounting for the work of sound artists Carsten Nicolai and Ryoji Ikeda. As a stress test of experimenter demand effects, we run an experiment where subjects can physically destroy coupons awarded to them. About one subject out of three does. Giving money back to the experimenter is possible in a separate task but is more consistent with an experimenter demand effect than an explanation based on altruism towards the experimenter. A measure of sensitivity to social pressure helps predict destruction when social information is provided.

I agree with Capra that autopoiesis is the signature of life and that Maturana did well to reject Cartesian dualism. Contrary to how mainstream biology defines life, I point out that reproduction is a consequence of life, not its origin. Furthermore, I address the questions of whether both autopoiesis and cognition together are necessary for life and whether autopoiesis can be extended beyond the molecular domain. I also have words of criticism for Maturana, who called for “objectivity” to be put (...) in parentheses, and conclude with a reminder that it was Varela who was instrumental in making autopoiesis a household term.
